Terms and Conditions for Sindamsang

Welcome to Sindamsang, an EdTech app designed to provide interactive and engaging educational experiences for preschoolers aged 2-6. By using Sindamsang, parents or guardians agree to these terms on behalf of themselves and their children.

This agreement complies with the following Indian laws:

• Information Technology Act, 2000 (IT Act) and its amendments.
• IT (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.
• Personal Data Protection Bill, 2019 (pending enactment).
• Juvenile Justice (Care and Protection of Children) Act, 2015.
• Consumer Protection Act, 2019, and other relevant laws.

By using Sindamsang, you confirm your compliance with these laws and any additional applicable regulations.

• Sindamsang is intended for use by children under the age of 6, but it must be accessed under the supervision of a parent or legal guardian.
• Only individuals aged 18 or above (parents/guardians) may create accounts and agree to these terms.

Sindamsang is committed to safeguarding your privacy and ensuring compliance with Indian data protection laws.

1. Parental Consent: Parents/guardians must provide explicit consent for the collection and use of their child’s data.

2. Data Collected:

• Personal Data: Child’s first name, age, and interests (to personalize content).
• Usage Data: Interaction logs, preferences, and progress metrics to improve the app’s experience.

3. Data Usage and Security:

• Data is securely stored on servers compliant with the IT Act, 2000, and other applicable regulations.
• No data will be shared with third parties without explicit parental consent, except when required by law.

4. Parental Control: Parents/guardians can access, modify, or delete their child’s data by contacting us at privacy@sindamsang.in.

• All content in Sindamsang (including text, images, videos, and activities) is the intellectual property of Design Gama and is protected under the Indian Copyright Act, 1957.
• Users may not copy, distribute, or modify any content without prior written consent.
• Any user-generated content (e.g., feedback or reviews) may be used by Sindamsang for promotional purposes.

Sindamsang offers premium content through subscriptions or in-app purchases:

• Payment Terms: Payments are processed in INR using trusted gateways compliant with Reserve Bank of India (RBI) guidelines. Applicable taxes, including GST, will be added to the purchase price.
• Refund Policy: Refunds will be provided only in cases of technical issues or valid disputes, in compliance with the Consumer Protection Act, 2019. Requests can be submitted through billing@sindamsang.in.

We prioritize the safety and well-being of children:

• Age-Appropriate Content: All activities, games, and lessons are carefully curated for children aged 2-6.
• Parental Supervision: Parents/guardians are required to monitor their child’s usage of the app.
• Anti-Bullying and Harassment: Any social or interactive features (if applicable) are moderated to prevent misuse.

Our practices align with the Juvenile Justice (Care and Protection of Children) Act, 2015, to ensure child safety.

Parents/guardians and users agree not to:

• Use Sindamsang for any unlawful purposes under Indian laws.
• Copy, modify, or tamper with the app’s code or functionality.
• Upload any offensive, defamatory, or harmful content.

Sindamsang is provided as an educational tool to supplement early childhood learning. We do not guarantee specific learning outcomes.

Design Gama will not be liable for:

• Interruptions in service due to technical errors.
• Loss of data caused by unauthorized access or user negligence.
• Any indirect, incidental, or consequential damages.

This agreement is governed by the laws of India, including the IT Act, 2000.

In case of disputes, users agree to resolve them through arbitration under the Arbitration and Conciliation Act, 1996. The arbitration will take place in Moirang, Manipur, India, and the proceedings will be in English.

The courts of Moirang, Manipur, will have exclusive jurisdiction over any legal matters.

Sindamsang reserves the right to update these terms periodically to reflect changes in law, app functionality, or business practices:

• Users will be notified of significant updates via email or in-app notifications.
• Continued use of the app after updates constitutes acceptance of the revised terms.
